The ingredient that keeps landing this label claim in court is not a flavor. It is malic acid.
“No artificial flavors.” Next time that line shows up on a front panel or a supplier spec, it helps to know how narrow it is.
In the US, an artificial flavor is any substance added to impart flavor that does not come from a spice, fruit, vegetable, edible yeast, herb, plant material, meat, fish, poultry, eggs, dairy or their fermentation products (21 CFR 101.22(a)(1)). The claim rests on that definition, so it tests where a substance came from and why it was added.
Vanillin fermented from ferulic acid, a natural source, is allowed. So are artificial colors and synthetic preservatives, since neither is a flavor. The same vanillin synthesized from petrochemical feedstock is ruled out, and so is any other synthetic substance added to impart flavor.
The two vanillins are chemically identical. Only the paperwork on the source tells them apart.
Then there are the acids. Synthetic DL-malic acid is common in fruit drinks and candy, and it is usually added for tartness and listed as an acidulant. In May 2026 the Ninth Circuit let a “free of artificial flavors” case over DL-malic acid in licorice go forward (Trammell v. KLN), saying the test is what a reasonable consumer expects, whatever the FDA category. In 2019 Ocean Spray agreed to pay $5.4 million to settle a similar case over malic and fumaric acid.
The fair objection is that the acid adjusts acidity and is not the fruit flavor. FDA’s categories support that reading, and it may still win at trial. It has not stopped the lawsuits.
Before the claim goes on pack, ask the flavor supplier for the written certification that 21 CFR 101.22(i)(4) requires for any flavor sold as containing no artificial flavor. Then check the acids you add yourself, because that certification only covers the flavor the supplier ships. A lab test settles it. Natural malic acid is the L form only, so any D form points to a synthetic source.
